NE*000 and kernel >~ 2.1.105 problems

hi!
i've got some problems getting my NE*000 ISA-Clone
working with kernels >2.1.105 (<=2.1.105 and 2.0.xx kernels work).

the error message sounds like:
ne.c ................
not found.........(invalid signature 43 53)

and additional:
..........ne.o: init_module: Device or resource busy

i tried
* compiling as a module and not 
* egcs 1.0.3a and pre-release 2
* with/without the SUPPORT_NE_BAD_CLONES option in ne.c

a diff with older working ne.c versions revealed no significant
changes (at least for me).
has someone an idea?
