2.2.0 on Miata and Sound

I just compiled 2.2.0 with ac1 patches
the sb_ess driver had a reference to udelay() missing
I could correct this by inserting the line
#include <linux/delay.h>
drivers/sound/sb_ess.c
This line is obviously missing

But now when I try a
modprobe sb io=220 irq=5 dma=1
I get 
/lib/modules/2.2.0ac1/misc/sb.o: init_module: Device or resource busy
sound: Device or resource busy

Any hints?
