Well-written programs that talk to the kernel (such as glibc) need the 2.4
headers to map stuff for the 2.4 kernel.
In general, these programs remain compatible with 2.2.
Apart from glibc, modutils, & procinfo come to mind.
For most programs, it doesn't matter which headers are there.
