Read the rest of that section of the GPL:
For example, if a patent license would not permit royalty-free
redistribution of the Program by all those who receive copies
directly or indirectly through you, then the only way you could
satisfy both it and this License would be to refrain entirely from
distribution of the Program.
So if Fraunhofer allows any GPL distribution, anyone can take that code
(or a derived work) and distribute it under the terms of the GPL (which
means that Red Hat or TiVo for example can sell it without paying
license feeds to Fraunhofer). Under the terms of the GPL, Fraunhofer
cannot allow free/non-commercial distribution and restrict commercial
distribution of the same code.
