Procps > 3.0 produces no output

I have a custom ssh client that I use to connect to a redhat WS 3.0 server. When I run top -n 1 -d 2 > out.txt the output file is blank and I get no error output. The command comes back very quickly so I don't even think it is running. If I downgrade procps to 2.x then the problem goes away.
Telnet does not show this behavior. I figure it is something with the shell/terminal but don't have a clue. Any seen anything like this?
