Yes.  IIRC, I think you have the original up2date from the original
RHELv3 install.  You have to get the latest up2date RPM's via FTP from
RH and then update up2date.  

Then you can update your kernel in the usual manner.

P.S. It would be nice if you would divulge the "fatal error" rather than
