Yes, that's hard-wired into the kernel - see how ext3 is mentioned
before ext2 in fs/Makefile.  

Recent kernels include the `rootfstype=' LILO parameter and this
allows you to override the default selection order.

So `rootfstype=ext2' will mount root as ext2 even if the kernel
has ext3 in it.
