Yes I've seen that too.  However I've checked the spec for kernel-2.6
and it is marked as %dir.

That seems to be an up2date but, it's being to strict on comparison.
ISTR discussing it with Adrian but can't remember if it's in bugzilla.
Note if you do

up2date --get kernel, and then rpm -ivh
/var/spool/up2date/kernel-<version> then that works, so it's not rpm
complaining.
