Red Hat Training Policies

General Terms and Conditions

Master Agreement: All terms and conditions of your master agreement with Red Hat that governs your purchase of Training (for instance the Red Hat Enterprise Agreement available at https://www.redhat.com/en/about/agreements) and Red Hat’s Appendix 2A: Training and Training Units, apply to the purchase and consumption of Red Hat Training, in addition to the policies herein (these “Policies”). Capitalized terms that are used in these Policies but are not defined have the meanings given to those terms in your master agreement and Red Hat’s Appendix 2A.

Modifications and Updates to the Training Policies: Red Hat reserves the right, at its sole discretion, to modify or update these Policies either by posting a revised version of these Policies at https://www.redhat.com/en/about/red-hat-training-policies or by providing notice by other reasonable means. If you do not agree to the modified or updated Policies, then (a) the existing Policies will continue to apply to the Training you purchased as of the date of the modification or update for the remainder of the then-current Training term(s), and (b) the updated Policies will apply to any new purchases or renewals of Training made after the effective date of the updated Policies.

Cancellation and Rescheduling of Classes by Red Hat: Red Hat may cancel or reschedule a class, including a component of a Bundle, at its discretion. In the event of such cancellation, Red Hat will use commercially reasonable efforts to provide notice of such cancellation fourteen (14) calendar days prior to the class start date. Client will not be charged for the Red Hat cancellation or rescheduling. Red Hat is not liable for expenses incurred for Client’s travel expenses or hotel accommodations in the event that Red Hat cancels or reschedules an event.

Requirements: Client is responsible for ensuring it meets the requirements of the event in which it is enrolling. Red Hat offers skills assessments that help guide Client in enrolling in the proper course for their background. Additionally, Client can contact its local Red Hat Training sales representative for further guidance.

Right of Dismissal: In order to maintain a classroom environment that is conducive to learning, Red Hat reserves the right to dismiss a participant from any Red Hat training or exam event. A participant who harasses other participant(s) or instructor(s), or who in Red Hat's sole judgment acts inappropriately or disruptively during class, may be dismissed from the event and may not return to the premises. In case of such dismissal, Red Hat’s liability will be limited to the refunding of fees paid by Client for the course or exam, and Red Hat shall not be responsible for any consequential loss or inconvenience arising whatsoever.

Special Accommodations Policy: Red Hat may make special accommodations, on a case-by-case basis, for open enrollment classroom students, classroom exam candidates and Red Hat Individual Exam candidates, who have special needs. Participants with special needs should notify Red Hat of such needs a minimum of two weeks prior to their desired class/exam by filling out a Special Accommodations Request (SAR) form. In the case of special needs of a medical nature, a participant must have their medical/rehabilitation professional fill out a Special Accommodations Request (SAR) form. Such form should be faxed back to the indicated fax number on the form. Red Hat will review the request and contact Participant about it.

Privacy Statement: Unless terms of the applicable master agreement state otherwise, any personal data collected as part of your participation in Red Hat training or an exam event will be used by Red Hat and its affiliates and subsidiaries for legitimate business purposes in accordance with its Privacy Statement. As detailed in the Privacy Statement, Red Hat may use your personal data to fulfill your request and to provide you with the products, services, support and customer service. Red Hat may share your information with service providers that provide services related to the Red Hat training and exam event. Providing your information to Red Hat may involve transferring it to another country. You can read more about how Red Hat collects, uses and discloses personal data, your rights and choices, the transfer of personal data and other privacy practices of Red Hat when you read Red Hat’s Privacy Statement.

Minors Policy: In accordance with Red Hat’s Privacy Statement, Red Hat does not knowingly accept information from minors under the age of 16 online. Moreover, we require parental or guardian consent from minors under the age of 18 who wish to register for Red Hat Training. Accordingly, minors (under 18 years old) who desire to register for Red Hat training and/or certification exams must have their parent or guardian read and sign the Parental Consent form and fax it to the indicated contact at Red Hat, prior to enrollment.

Limitation of Liability: Red Hat shall not be liable for any interruption or delay of service, loss of service time, loss of personal data or other defects in any service provided (including failure to provide such service), if such interruption, delay, loss or defect are the result of actions or events beyond Red Hat’s reasonable control, including, but not necessarily limited to force majeure events, acts of foreign governments, and war.

Not For Resale: Resale of Red Hat training products and exams, by the purchaser to a third party, is strictly prohibited, unless the purchaser is an active authorized Red Hat distribution partner, reseller partner or training reseller partner. Red Hat reserves the right, at its sole discretion, to refuse to deliver service on any Red hat product or exam that has been resold by a non-authorized party.

Export Control Restrictions: Red Hat observes and abides by all United States export control guidelines and sanctions rulings on applicable countries, organizations and individuals. Red Hat will not deliver any training events or services, public or private, to organizations or individuals subject to US export control restrictions or sanctions. And, no attendance in classes or purchasing of subscriptions, online access or other training materials and content will be allowed by any government, organization or individual subject to United States export control restrictions and sanctions, or by any organization or individual operating or residing in any country or region of a country currently under US export control restrictions or sanctions, regardless of where such purchases may originate or where the Red Hat training events in question are being held. Individuals residing in the embargoed territories of Crimea, Cuba, Iran, North Korea, Syria and Sudan are prohibited from purchasing and Red Hat products, attending Red Hat training or taking exams with Red Hat, a company headquartered in the United States and subject to U.S. Export Administration regulations. Individuals who present approved candidate identification showing a non-embargoed country residence may attend Red hat Training, take Red Hat exams and receive certifications.

Open Enrollment Training

Registration: Open enrollment events are exclusively for registered Named Participants. Unregistered individuals may not attend or view an event at any time.

Prohibited Use: Unauthorized recording, copying, or transmission of Open Enrollment content is strictly prohibited.

Cancellation and Rescheduling of Open Enrollment Events: Client may reschedule or cancel a purchased seat in a class or exam up to fourteen (14) days prior to the class/exam start date. If Client cancels a class or exam at least fourteen (14) calendar days prior to the class/exam start date, Client is eligible to receive a refund of paid registration fees, upon request. Client will not be eligible for a refund of paid registration fees if Red Hat does not receive a notice of cancellation or rescheduling at least fourteen (14) calendar days prior to the class/exam start date.

Substitution of Enrollees: Client may substitute enrollees as long as the substitution is made no fewer than 7 calendar days prior to the class start date for classes or the exam date for exams. It is the responsibility of Client to ensure that the substitute enrollee meets the stated course prerequisites and is provided with any course materials already provided to enrollees.

Virtual Training (VT): All Open Enrollment terms and conditions apply to Virtual Training. Registered Named Participants enrolled in a Virtual Training event must view the event from the country listed on the registration form. No individuals other than the Named Participant may view a Virtual Training event with the Named Participant. And, unauthorized recording, copying, or transmission of VT content is strictly prohibited. The student materials for VT classes are provided in hard copy or digital format (eBook). Once a Named Participant has been sent a hard copy or granted access to the student guide eBook/kit for an event, the event will be non-refundable, and Named Participants may not be substituted.

Virtual Training System Requirements: Clients are responsible for meeting the minimum system requirements to attend VT. It is Client’s responsibility to ensure the compatibility of his/her system and that the system and network performance comply with Red Hat’s requirements.

Guaranteed to Run (GTR): Red Hat may designate certain published open enrollment and virtual training events as Guaranteed-to-Run (GTR). A GTR notification can be found on scheduled course listings. Red Hat reserves the right to remove or cancel a GTR class if there are no paying students enrolled twenty-one (21) days prior to the start date of the class.

Substitution by Red Hat: If Red Hat removes a class from its open enrollment training portfolio, Red Hat reserves the right to substitute with a similar class that will be offered at the same location and date.

Changes/Suspension: Red Hat reserves the right to change the schedule of a GTR class if prevented from delivering the class by causes beyond Red Hat’s reasonable control, such as but not limited to: nonperformance or delays caused by acts of God, wars, riots, strikes, fires, floods, hurricanes, earthquakes, government restrictions, terrorist acts, or other causes beyond its reasonable control.

NO GUARANTEE: NOTWITHSTANDING ANYTHING TO THE CONTRARY IN YOUR AGREEMENT, RED HAT DOES NOT GUARANTEE THAT RED HAT TRAINING WILL BE PROVIDED UNINTERRUPTED OR ERROR-FREE EVEN FOR CLIENTS WHO SUCCESSFULLY COMPLETED THE SYSTEM TESTING PROCESS PRIOR TO THE CLASS START DATE.

Onsite Training

Onsite Training consists of instructor-led classes and certification exams delivered to a specific client(s) at the client site, at another location designated by client or Red Hat, or via Virtual Training over the internet.

Red Hat-Provided Mobile Classroom Lab Environment: If Client is using a Red Hat-provided mobile classroom lab environment, an additional fee will apply, as specified in the Order Form. Client will be liable for any loss or damage to the equipment and hardware provided as part of the Mobile Classroom Lab Environment.

Expenses: Expenses for private on-site classes shall be charged on an event basis as specified at the time of your order and included in your total price, as specified in the Order Form.

Cancellation and Rescheduling: Client must cancel or reschedule an onsite training class or onsite exam no fewer than fourteen (14) calendar days prior to the scheduled event start date. If notice of cancellation or rescheduling is received within 1-13 days prior to the event start date, a cancellation/rescheduling fee equal to 50% of the total fee for the onsite class or exam is due to Red Hat from Client. If notice of cancellation or rescheduling is received on the class/exam start date, a cancellation/rescheduling fee equal to 100% of the total fee for the onsite class or exam is due to Red Hat from Client. Fees charged for cancellation or rescheduling will not be applied to any rescheduled training classes or exams, or any other future training purchase from Red Hat.

Expiration of Onsite Training Purchase: On-site training must be consumed within 12 months of the date of purchase except as otherwise approved by Red Hat in writing. Failure to consume the purchased onsite training within 12 months of the purchase date will result in forfeiture of the purchased training and no refund will be due to Client.

Red Hat Certification and Preliminary Exams General Terms

These Red Hat exam General Terms apply to all Red Hat Certification and Preliminary Exams.

Certification: Granting of Red Hat certified status is at the sole discretion of Red Hat. Red Hat certified professionals are expected to abide by all applicable Red Hat exam policies, applicable Red Hat Exam Confidentiality Agreements, and testing guidance and procedures. Red Hat certified professionals should provide truthful documentation regarding their identity. To protect the integrity of the Red Hat exams and certifications, Red Hat certified professionals are expected to maintain at all times the highest standards of integrity and comply with all applicable laws and regulations. Any violation of these Training Policies or of the Red Hat Exam Confidentiality Agreement or Red Hat Exam Privacy and Confidentiality Agreement (in case of Red Hat Individual Exams and Preliminary Exams) may result in penalties provided for in the applicable Agreement and these Training Policies, including, but not limited to, nullification of exam results and revocation of exam pass status and certification.

Identification: All Named Participants must provide a current government-issued photo identification (ID) at the time of the exam.

  • Norwegian bank cards, commonly used as government ID equivalents for air travel and other critical identity checks may be used as identification for exams taken in Norway.

  • A Named Participant, who changes his or her name after registration, must provide legal documentation recognizing the change to be admitted to take the exam.

  • Under no circumstances may a Named Participant sit for a certification or expertise exam without providing positive photo identification as defined by these policies. Red Hat will expunge any certification or credential earned for Named Participants who have provided falsified information or who are found not to have provided positive identification for an exam.

Wearing/Use of Personal Devices in Testing Locations:

  • Due to the increasing difficulty in identifying SMART devices, the following items may not be worn during an exam:

    • Watches

    • Rings (except wedding band and engagement ring)

    • Bracelets

    • Ear pieces (except for medically-approved hearing devices)

    • Head pieces - If a Named Participant cannot remove a head piece for medical, cultural or religious reasons, the Named Participant must complete a Special Accommodations Request (SAR) form at least two weeks prior to the exam.

    • Any type of Headphones or Headsets

    • Earphones or Earbuds

  • Named Participants may not use or have out at any time during a Red Hat exam any digital materials or Smart or connected devices including but not limited to: Smart phones, tablets or other similar Smart devices.

  • Named Participants must turn off and unplug any other laptops, computers, displays, or any other personal equipment or hardware. Access to any systems or networks is not allowed when the device is being used for taking a Red Hat exam.

  • When taking a Red Hat Classroom Exam, Named Participants are strictly prohibited from using any materials in any form other than those provided by Red Hat during the Red Hat Classroom Exam.

  • For Named Participants who file a Special Accommodations Request (SAR) form that is subsequently approved by Red Hat, the following standard accommodations can be made:

    • For Red Hat Individual Exams, an extended amount of time to complete the exam can be provided.

    • For Red Hat Classroom Exams, special accommodations may include a separate room, larger monitors, additional time to complete the exams, as well as other potential accommodations.

Confidentiality of Certification and Preliminary Exams:

  • The integrity of Red Hat exams and fairness to all current and future candidates depends on the confidentiality of the Red Hat exam content and lab environment. Red Hat does not make any exam content or exam lab environment public and does not authorize the publication, dissemination or disclosure of any exam content or exam lab environment. All past, present and future exam content, solutions and lab environments are Red Hat’s proprietary confidential information and Red Hat is solely disclosing information to Named Participants for the purpose of testing their knowledge of the exam subject matter for which they seek certification. Red Hat retains all rights, title and interest in and to all certifications, programs, confidential information, and related information, and all copyrights, patent rights, trademark rights and other proprietary rights therein.

  • Named Participants are expressly prohibited from reproducing, transmitting or otherwise disclosing any exam content, solutions and lab environments related to, or disclosed to them in connection with, the Red Hat exam, in whole or in part, in any form or by any means, including visual, oral or written, whether by social media, or any type of electronic or mechanical means, for any purpose to any individual(s) or other third parties. Named Participants further agree to keep all such exam content, solutions and lab environments confidential unless and until they become generally available to the public through no fault of theirs, or unless Red Hat provides prior written authorization of a particular disclosure.

  • If Named Participants disclose such confidential Information in violation of this Section by any means, they will be undermining the integrity and security of the Red Hat exam and any certification program associated with it and, accordingly, they agree that Red Hat may revoke their Red Hat certifications (including prior certifications), nullify their results and bar them from taking any additional Red Hat exams in addition to pursuing other legal actions permitted under applicable law. Such disclosure (or threatened disclosure) may cause irreparable harm to Red Hat for which monetary damages may be insufficient and, in such event, Red Hat shall be entitled to seek all available equitable remedies, including and without limitation injunctive relief.

  • Named Participants further acknowledge and agree that while taking a Red Hat proctored exam (i) with the exception of an exam delivered by an authorized proctor in a classroom setting, if any other person(s) is (are) detected as being present in Named Participants’ workspace location, whether physically detected, overheard in any manner, by the making of noise or through sounds irrespective of whether they are in their immediate workspace location during the exam session or (ii) if the use of any material in any form and by any means or the use of any monitors, laptops, smart or connected devices, or any other personal belongings other than the device used for the purpose of Named Participants' exam is detected during the exam session, Red Hat may at its sole discretion terminate the exam, Named Participants may not receive any score and Red Hat may take the other actions set forth herein. In the event that Named Participants have completed the exam, their score may be invalidated or revoked. Furthermore, if Named Participants’ exam session is terminated for this or any other reason they will not receive a refund. If Named Participants do not agree to the terms set forth herein, they will not be allowed to proceed with the exam and will forfeit the full exam fee.

  • Cheating: Red Hat certification exams measure the ability of individuals to perform real-world tasks unassisted. To this end, the following behaviors are prohibited and may result in the pausing or immediate termination of an exam as it is being delivered or having exam results overturned and a certification withdrawn if evidence of these behaviors is discovered during or after the exam delivery.

    • Use of any materials in any form or by any means other than those provided in the exam environment during the exam.

    • Communications with anyone other than an exam's proctor during the exam.

    • Use of any system other than the one(s) provided specifically to the Named Participant during the exam.

    • Any other means for acquiring an unfair advantage with respect to the content or delivery of an exam, before or during an exam.

    Published Exam Content: Red Hat does not authorize the publication of its exam content by third parties. All Named Participants represent that they have not used any such Red Hat content published by any third party in preparing for the exam. Exam results will be vacated and certifications withdrawn for any Named Participants found in breach of this policy. Red Hat reserves the right to bar individuals suspected of such behavior from taking exams.

    Exam Results and Delivery:

    • Exam Scores: Red Hat only reports total exam scores. Red Hat will not provide additional information or details beyond the contents of the score report provided to Named Participants.

    • Criteria for Passing: Criteria for passing a Red Hat exam is at the sole discretion of Red Hat. Additionally, Red Hat has the discretion to determine whether a Named Participant has passed a Red Hat exam based on an evaluation of that Named Participant’s performance on the Red Hat exam.

    • Exam Results: A Named Participant may file a challenge with Red Hat to their exam results within thirty (30) days of the date of delivery of their exam. Failure to file a challenge within thirty (30) days will result in forfeiture of the Named Participant’s right to challenge their exam results. Red Hat may conduct a review of the challenge, at its sole discretion. All Red Hat decisions regarding a challenge to exam results shall be final.

    • Delivery of Exam Results: Red Hat will make a commercially reasonable effort to deliver exam results to the Named Participant within three (3) United States business days after the exam date. Named Participants are responsible for providing a valid email address to which Red Hat can deliver exam results. Red Hat is not responsible for results that are not deliverable due to the Named Participant providing an invalid email address, or to any email configuration on the Named Participant’s device.

    Red Hat Individual Exams

    Red Hat Individual Exams are certification exams administered via specially configured testing systems. Individual Exams can be delivered at a Red Hat testing center or online as a Remote Exam.

    Individual Exam Scheduling: Named Participants have one (1) year from date of purchase to schedule and take the exam. No extensions of the one (1) year term will be granted. A Named Participant must schedule their exam start time no less than twenty-four (24) hours prior to their selected start date and time.

    No Cancellation of Purchase: All Red Hat Individual Exam purchases are final, and fees are non-refundable.

    Daily Limit: A Named Participant may not take the same exam more than once in the same day. Red Hat may at its sole discretion elect to enforce a minimum interval between exam attempts.

    Rescheduling Individual Exams: Individual Exams can be rescheduled up to 24 hours prior to the scheduled exam session. Any changes made to the start time of a scheduled exam less than twenty-four (24) hours prior to the scheduled start time will result in forfeiture of the Named Participant’s exam authorization.

    No Exchange for Red Hat Classroom Exams: Red Hat does not permit exchanging an Individual Exam for a Classroom Exam. In the event that a Named Participant chooses to change their scheduled Individual Exam to a Red Hat Classroom Exam, they will be required to cancel their Individual Exam and book a new Red Hat Classroom Exam, thereby forfeiting their Individual Exam fees.

    Substitution of Named Participants: Named Participant substitution for Individual Exam sessions is not allowed at any time.

    Late Arrivals and No Show Policy: Failure to attend an exam, or arriving more than 15 minutes after the start time of an exam will result in forfeiture of the exam session and fee, and the Named Participant will not be eligible to reschedule the exam.

    Country of Purchase: Unless otherwise approved by Red Hat in writing, all Individual Exams must be taken in the enrollee’s country of residence at the time of purchase. Named Participants are prohibited from taking their exams remotely from a country under embargo by the United States.

    Red Hat Individual Exam Day Rules and Requirements:

    • Identity Authentication: A photo of the Named Participant Named Participant will be taken prior to the start of the exam and the Named Participant must present a current government issued photo identification. Government issued identification that uses non-Latin characters must be verified by a local Red Hat representative at the testing location or the online proctor in the case of Remote Exams prior to the Named Participant taking a Red Hat exam.

    • Individual Exam Monitoring: Named Participant taking an Individual Exam will be continuously monitored in real time by a Red Hat proctor via a live video feed from the Named Participant’s device camera. Communication with the proctor is available in several languages. The proctor will guide Named Participants through the onboarding process using live video and has the discretion to immediately terminate the exam if a Named Participant is suspected of cheating or any type of misconduct. Such violations will be immediately reported to the Red Hat Certification team, which may result in penalties including, but not limited to, nullification of exam results and revocation of exam pass status and certification.

    Red Hat Certification and Preliminary Exam Privacy Agreement:

    By participating in an Individual Exam, Named Participants acknowledge, agree and consent to the taking of video recordings of their face, image, desk, workspace and possible audio recordings during the exam for the purposes of exam quality, security and the integrity of the exam process. Named Participants consent to the continuous monitoring of them by video in real time while they take the exam, the processing of such personal data by Red Hat and its third party data processors, and the transfer of such data to Red Hat and its third party data processors in the United States or other countries where they are located. Named Participants acknowledge that they have no expectation of privacy as regards their face, image, audio or actions during the exam, and agree to waive any and all claims asserting a violation of their right to privacy during the exam insofar as such claims pertain to the recording of their face, image, audio or actions during the exam. If Named Participants do not agree to be recorded by video for the monitoring purposes as described, they will not be allowed to proceed with the exam.

    Maintenance of Exam Data and Digital Artifacts: Red Hat saves and stores various digital artifacts associated with Individual Exams, including disk images for the virtual machines used during an exam, the video recording of the exam session, and chat logs, among other elements. Due to the constraints of local storage capacity, Red Hat cannot guarantee the maintenance of any artifacts for any specific period of time. Red Hat is also not responsible for the loss of digital artifacts due to causes beyond Red Hat’s reasonable control, including, but not necessarily limited to, hosting facility error or negligence, fire, theft, vandalism, war, acts of foreign governments, or other force majeure events.

    Individual Exams are subject to the Red Hat Exam Privacy and Confidentiality Agreement. Violation of these policies or other behavior that suggests misconduct may result in the remote monitor pausing or terminating an exam.

    Red Hat Remote Exams

    Red Hat Remote Exams provide an individual online testing option that is both convenient and flexible. A Named Participant is responsible for providing their own device and connectivity. Remote Exams are certification exams delivered through a configured and restricted live environment for the sole purpose of delivering the Red Hat Remote Exam. Nothing is installed on Named Participants’ systems during the exam session and Red Hat does not save any information or hold any information on the devices after Named Participants log out from their exam session.

    Red Hat Remote Exam-Specific Compatibility Test: Named Participants are recommended to run a compatibility test from within the Remote Exam live environment in advance of their scheduled exam date preferably at the same time of day as the scheduled exam. This allows Named Participants to check the compatibility of the hardware and network that they plan on using to take the exam. A successful run of the compatibility tool does not guarantee the absence of issues when the exam is delivered. Because Named Participants will use their personally provided device, location and network, Red Hat cannot troubleshoot these for any of the Named Participants. In the event there are problems that significantly impede Named Participants’ ability to take the exam, Red Hat at its sole discretion will allow the Named Participant to discontinue and reschedule the exam at a later date.

    Red Hat Remote Exam System and Hardware Requirements:

    • Named Participants electing to take a Remote Exam must meet certain system and hardware requirements as published by Red Hat and provided to Named Participants. Red Hat may update these requirements from time to time at Red Hat’s sole discretion. It is the responsibility of the Named Participant to ensure that their device and connectivity meet any requirements published by Red Hat.

    • The hardware requirements include the use of two reliable web cameras, which constitute one of the prerequisites to taking the Red Hat exam remotely. A sustained interruption of the web camera feed may result in the termination of the exam session without refund.

    Red Hat Remote Exam Workspace Policy

    • In addition to the above policy regarding “Wearing/Use of Personal Devices in Testing Locations”, Named Participants taking a Red Hat Remote Exam will need to ensure that there are no Smart devices, writing instruments or objects (including but not limited to pens, pencils, markers), printed materials (including but not limited to paper, sticky notes, notepads, books, memo cards), or any items on the wall with writing (including but not limited to whiteboards or pictures) in close proximity or on their desks or in their workspace. If a Named Participant’s workspace does not pass a room scan, they will not be permitted to proceed with the exam. Suitability of the exam workspace is entirely at Red Hat’s discretion and an exam may be cancelled or rescheduled for any of the aforementioned reasons or for reasons other than those mentioned herein.

    • Only one physical display will be allowed for the exam. Named Participants must turn off and unplug any additional laptops, computers, monitors, displays or any other personal equipment or hardware in their workspace other than the computer or laptop used for the exam. Named Participants will not be allowed to proceed with the Remote Exam until the requirement specified herein is met.

    Red Hat Remote Exam-Specific Disclaimers:

    • Red Hat is not responsible for any issues arising from a Named Participant’s device being connected to the testing environment or any service issues arising from device performance, network connectivity, or functioning of the Named Participant’s network or the public network infrastructure, or use of hardware or software by a Named Participant that does not meet the requirements published by Red Hat.

    • Red Hat cannot assume responsibility for the proper functioning of a Named Participant’s network. Named Participants must choose a reliable network and run the compatibility test to ensure a suitable environment. Should network connectivity problems arise within the first 30 minutes of the exam and the Named Participant is unable to resolve the connectivity problems, they can request to have the exam attempt discontinued and will be allowed to reschedule the Red Hat exam.

    • Red Hat is not responsible for damage or other impact to a Named Participant’s device while connected to the Red Hat remote testing environment, or after they have logged off and out of the Red Hat remote testing environment, or as a result of taking the Red Hat Remote Exam, including but not limited to: the device being hacked; the device infected by any malicious software; any loss of data or any changes in the operation of a Named Participant’s device.

    Non-availability of Remote Exams in People’s Republic of China: Red Hat Remote Exams are not available or approved for sale or delivery or guaranteed for access in the People’s Republic of China. Red Hat makes no guarantee as to the quality of service, availability of access or continuity of access to Remote Exams in the People’s Republic of China. A Named Participant who purchases their Remote Exam in another country, and who attempts to access their Remote Exam in the People’s Republic of China, may experience a slower or diminished quality of service, or may find they are unable to access the Remote Exam environment. In any such case, no refund, compensation or rescheduled delivery shall be made to the Named Participant by Red Hat.

    Red Hat Preliminary Exams

    All terms and conditions of Red Hat Individual Exams apply to Red Hat Preliminary Exams unless otherwise noted below.

    Delivery of Preliminary Exams: A Preliminary Exam is delivered to a Named Participant via the internet.

    Named Participant Device and Connectivity: A Named Participant is responsible for providing their own device and connectivity to access their Preliminary Exam via the internet. It is the responsibility of the Named Participant to ensure that their device and connectivity meet any requirements published by Red Hat and provided to Named Participants.

    Required Web Browser Software: Named Participant must use the internet browser software package and version referenced in their exam confirmation email. If the Named Participant does not use the required internet browser software, they will not be able to access their scheduled Preliminary Exam. Failure to successfully log in to the exam environment within twenty (20) minutes of the scheduled start time will result in forfeiture of the scheduled exam as well as any opportunity to reschedule the exam in question.

    Use of Connectivity Test Link: It is the responsibility of the Named Participant to use the connectivity test link provided by Red Hat to test the ability of their device and network connectivity to access the Preliminary Exam online. Any issues with connectivity or device performance must be addressed prior to the scheduled exam start time.

    Connectivity Disclaimer: Red Hat is not responsible for service issues arising from device performance, network connectivity, functioning of the Named Participant’s network or the public network infrastructure, or use of hardware or software by the Named Participant that does not meet the requirements published by Red Hat.

    Preliminary Exam Monitoring: A Named Participant will be monitored by a Red Hat proctor via a live video feed from the Named Participant’s device camera. Any interruption of the video connection may result in termination of the exam session, without refund.

    Non-availability of Preliminary Exams in People’s Republic of China: Preliminary Exams are not available or approved for sale or delivery or guaranteed for access in the People’s Republic of China. Red Hat makes no guarantee as to the quality of service, availability of access or continuity of access to Preliminary Exams in the People’s Republic of China. A Named Participant who purchases their Preliminary Exam in another country, and who attempts to access their Preliminary Exam in the People’s Republic of China, may experience a slower or diminished quality of service, or may find they are unable to access the Preliminary Exam environment. In any such case, no refund, compensation or rescheduled delivery shall be made to the Named Participant by Red Hat.

    Red Hat Online Learning (ROLE) Subscription

    Red Hat Online Learning offers an online, HTML5 self-paced learning experience available for all courses and in multiple languages. ROLE is supplemented with 90-days of unlimited access to course content, 80 hours of cloud-based labs, and webinars from Red Hat experts.

    • Term: The Term of a Role Subscription is ninety (90) days from the start date selected at the time of order. Interruption of service shall not be cause to modify the Term of the subscription. Any adjustment to the Term of the subscription will be at the sole discretion of Red Hat.

    • ROLE Subscription Renewals: ROLE Subscriptions may be renewed, upon mutual agreement of the Client and Red Hat, for successive ninety (90) day Terms. Renewal of the Subscription will be at the list price for the subscription, at the time of renewal, unless otherwise approved by Red Hat or a Red Hat Authorized Reseller Partner.

    • Named Participant: A ROLE Subscription is limited to a single registered Named Participant. Unregistered individuals may not view any ROLE content at any time. Unauthorized recording, copying, or transmission of ROLE content is strictly prohibited.

    • Limitation of Availability for Named Participant Use Data: Red Hat does not guarantee the continued availability of a Named Participant’s use data for any expired subscription, including but not necessarily limited to course progress, lab environments, exam availability, and user configuration changes.

    • Sharing of Named Participant Use Data: Red Hat reserves the right to share a Named Participant’s use data or other subscription related information with parties related to the purchase and management of the subscription. This may include, but is not limited to, the purchaser of the subscription, the Named Participant’s supervisors and managers, and the training staff of the Named Participant’s employer.

    • Country of Purchase: The Named Participant must view the class from the country from which it was purchased, as indicated at the time of order.

    • Cancellations: Client may not cancel ROLE subscriptions at any time.

    • Right of cancellation by Red Hat: If the Named Participant or Client violates the terms of use of a ROLE subscription, such as by allowing multiple users access to a single Named Participant’s materials, Red Hat may cancel the ROLE Subscription, prior to its expiration, without refund.

    • Rescheduling the start date: Client may not reschedule the start date of a ROLE subscription at any time.

    • Delayed start date: While Client may not reschedule the start date of the ROLE subscription, the start date may be scheduled up to 90 days after the effective date of purchase, if agreed in writing.

    • Substitution of enrollees: During the term of the ROLE subscription, substitution of the single Named Participant is not permitted except as otherwise approved by Red Hat in writing.

    • Software Requirements: Accessing a ROLE classroom requires a modern browser. Verify that your system meets the requirements for ROLE by accessing the Compatibility Test Page for Red Hat Training.

    • Access to Labs: A ROLE Subscription makes a Named Participant eligible for 80 hours of lab access. Red Hat reserves the right to periodically remove inactive lab environments. Lab environments that have not been accessed within the preceding seven (7) day period are subject to deletion. Some exclusions may apply. As long as a Named Participant has enough remaining lab hours, they may re-provision a lab for the course in question. However, where a lab environment has been deleted, any progress or state information of the deleted lab will be lost and will not be restored upon the re-provisioning of the lab. After the end of the subscription Term, any unused labs hours will be forfeited. An, no refunds or credits will be provided for unused lab hours.

    • Lab Support: In order to support the lab needs of a Named Participant, Red Hat Technical Support Engineers may need to power on and use a Named Participant’s lab environment to resolve issues reported by the Named Participant. This troubleshooting support time will be charged against the Named Participant’s lab hour allotment.

    • eBook Download: With a ROLE subscription, the Named Participant may download the eBook associated with each ROLE course one (1) time during the subscription term.

    • Content updates and changes: Red Hat reserves the right to add, update, or remove content and other features to the Subscription at Red Hat’s discretion without notice.

    • Content language: ROLE Subscription materials are available in English. Some materials may be made available in other languages however Red Hat does not guarantee that content will be available in languages other than English. Where non-English, translated content is made available, Red Hat does not warrant the accuracy of such content.

    • Non-availability in People’s Republic of China: Red Hat Online Learning (ROLE) is not currently approved for sale or guaranteed for use in the People’s Republic of China. Red Hat makes no guarantee as to the quality of service, availability of access or continuity of access to ROLE in the People’s Republic of China. A Named Participant who purchases their ROLE in another country, and who attempts to access their ROLE in the People’s Republic of China, may experience a slower or diminished quality of service, or may find they are unable to consistently able to access the service. In any such case, no refund or other compensation shall be made to the Named Participant by Red Hat.

    • NO GUARANTEE: NOTWITHSTANDING ANYTHING TO THE CONTRARY IN CLIENT’S AGREEMENT, RED HAT DOES NOT GUARANTEE THAT RED HAT TRAINING STREAMS WILL BE PROVIDED UNINTERRUPTED OR ERROR-FREE, EVEN FOR NAMED PARTICIPANTS WHO SUCCESSFULLY COMPLETE THE SYSTEM TESTING PROCESS PRIOR TO THE CLASS START DATE.

    Red Hat Learning Subscription (RHLS) General Terms

    The following general terms apply to all versions of Red Hat Learning Subscription unless otherwise provided for herein.

    • ROLE Terms Apply: All of the same Terms and Conditions for Red Hat Online Learning (ROLE) apply to all Red Hat Learning Subscriptions except as otherwise noted below.

    • Term: The Term for a Red Hat Learning Subscription is one (1) year from the start date selected by Client at the time of purchase. The start date must be within ninety (90) days of the purchase date.

    • Red Hat Learning Subscriptions Renewals: A Red Hat Learning Subscription may be renewed, upon mutual agreement of the Client and Red Hat, for successive one (1) year Terms. Renewal of the Subscription will be at the list price for the subscription, at the time of renewal, unless otherwise approved by Red Hat or an Authorized Red Hat Training Reseller Partner.

As long as a Named Participant has enough remaining lab hours, they may re-provision a lab for the course in question. However, as part of the aforementioned deletion, any progress or state information of the deleted lab will be lost and will not be restored upon the re-provisioning of the lab.

    • eBook Download: A Named Participant may download eBooks associated with RHLS online courses, subject to the following limits: (a) a Named Participant may download no more than one (1) eBook per day; (b) a Named Participant may download no more than ten (10) different eBooks during the subscription term.

    • Country of Purchase: A Red Hat Learning Subscription must be setup, accessed and consumed only in the country where the Named Participant resided when it was purchased.

    • Non-availability in People’s Republic of China: Red Hat Learning Subscription is not currently approved for sale or guaranteed for use in the People’s Republic of China. Red Hat makes no guarantee as to the quality of service, availability of access or continuity of access to Red Hat Learning Subscription in the People’s Republic of China. A Named Participant who purchases their Red Hat Learning Subscription in another country, and who attempts to access their Red Hat Learning Subscription in the People’s Republic of China, may experience a slower or diminished quality of service, or may find they are unable to consistently able to access the service. In any such case of service quality or interruption of service when being used in the People’s Republic of China, no refund or other compensation shall be made to the Named Participant by Red Hat.

    Red Hat Learning Subscription Standard Version (RHLS - Standard)

    The following terms and conditions apply only to RHLS - Standard and RHLS Enterprise – Standard.

    • Elements of RHLS - Standard:

      • All elements of Red Hat Learning Subscription described in the Red Hat Learning Subscription General Terms are included in Red Hat Learning Subscription Standard.

      • Instructor Office Hours – scheduled access to technical experts. This feature is only available if an expert cannot be provided for a requested Expert Chat session.

      • Expert Chat – on-demand access to technical experts

      • Expert Extras - Online recorded Expert videos

      • Five (5) Red Hat Individual Exam entitlements and two (2) unique exam retake entitlements per subscription year, subject to the conditions below. Exam entitlements included in a Red Hat Learning Subscription may only be used for Red Hat Individual Exams and Preliminary Exams and may not be applied to a Classroom Exam.

    • Exams for RHLS-Standard Named Participants: All of the same terms and conditions for Individual Exams and Preliminary Exams apply to Individual Exams and Preliminary Exams included as part of a Red Hat Learning Subscription, except as otherwise provided below.

      All terms and conditions of RHLS related to Individual Exams, and their access and consumption, apply to both Individual Exams and Preliminary Exams included in an RHLS – Standard subscription unless otherwise noted below.

      • Exam entitlements included with an RHLS – Standard subscription must be consumed during the one (1) year subscription period. Exam entitlements included in the RHLS – Standard subscription may not be used after the subscription has expired, and may not be carried over to a renewal term of a subscription.

      • A Named Participant should (but is not required to) complete the learning requirement associated with a given exam in order to register for a first attempt of an exam in a subscription year. Exams and their recommended learning paths are displayed on the Red Hat Learning Subscription Portal.

      • The two (2) exam retake entitlements can only be applied to exams taken during the subscription term as part of the RHLS - Standard subscription. Each exam retake must be used for a different Red Hat exam. For example, if the Named Participant fails an exam, they may use one of their retakes to take that same exam again. If the Named Participant fails the same exam a second time and wishes to retake the exam for a third time, they may not use their second retake for the same exam. Instead, the Named Participant will have to purchase a standalone exam authorization for the second retake of the exam in question.

      • Failure to comply with the terms and conditions concerning exam security and confidentiality may result in forfeiture of exam attempts and retakes included in RHLS - Standard.

    • RHLS - Standard Instructor Office Hours: Instructor office hours are phone or video-based meetings with technically qualified Red Hat support staff, to discuss course content issues or questions. A Named Participant may access and consume instructor office hours in accordance with the following terms and conditions.

      • Access to Instructor Office Hours: A Named Participant may access instructor office hours only if the Named Participant has requested an Expert Chat session for which an expert is not available. In such case, the Named Participant will be invited to schedule an instructor office hours session.

      • Scheduling an Appointment: Instructor office hours appointments are scheduled on an as available basis, and Red Hat reserves the right to cancel or reschedule office hour appointments. Red Hat may work with the Named Participant to coordinate the rescheduling of appointments, at Red Hat’s discretion.

        Red Hat may require additional time to arrange a technical resource for an Instructor Office Hour appointment, which may affect the ability to accept or schedule such requests.

      • Hours of Availability: Instructor office hours appointments are only offered Monday through Friday, exclusive of Red Hat holidays. Instructor office hours appointments may not be available at all hours of the day or within the business hours of all worldwide geographies.

    • Limitations on Topics Covered: Instructor office hours are intended as support only for Red Hat training courses provided as part of RHLS - Standard Subscription. Topics outside of the Red Hat training courses provided as part of the RHLS-Standard Subscription are not acceptable topics during instructor office hours appointments. Red Hat support staff will not discuss preparation for, results from, or content related to Red Hat Certification Exams as part of instructor office hours.

      • Instructor Office Hours are not Consulting Services. Red Hat technical support staff will not provide consulting on technical matters during instructor office hours.

      • Technical Issues: Issues concerning a Named Participant’s equipment or environment should be directed toward Red Hat Support if included in the support provided for valid and current Red Hat subscriptions.

    • RHLS – Standard – Expert Chat: Expert chat will allow an RHLS Standard Named Participant to connect to content support experts in real time, to solve challenges with course and lab materials. Additionally, Expert Chat offers a way for students to schedule an instructor office hours session, if a chat expert is not available.

      • Access to Expert Chat: The Named Participant must accept the Expert Chat terms and conditions before access to the Expert Chat tool will be granted.

      • Availability of Expert Chat and Wait Time: Expert Chat is on demand, and chat experts are assigned to requests on a first-come, first-served basis. Wait times for chat may vary. Any wait time communicated by the Expert Chat feature is only an estimate, and Red Hat does not commit to providing an expert within the estimated wait time.

      • Availability of Technical Expert: Expert availability for an Expert Chat will vary. In the event that an expert cannot adequately respond to the Named Participant’s inquiry in Expert Chat, the Named Participant may schedule an instructor office hours session to address their inquiry.

      • Session Time Limit: An individual Expert Chat session is limited to a maximum connect time of 30 minutes. In the event that a Named Participant’s chat inquiry cannot be resolved within the allotted session time, the Named Participant may, if they choose, schedule an instructor office hours session to address any additional discussion required.

      • Per User Session Limit: A Named Participant is limited to one chat session per business day, based on the business hours in the region where their account is located.

      • Limitation on Topics: Expert chat is intended only as support for Red Hat training courses provided in the RHLS – Standard subscription. Topics outside of the content of the Red Hat training courses included in the RHLS – Standard subscription are not acceptable topics to be addressed during Expert Chat sessions. Red Hat chat experts will not discuss preparation for, results from, or content related to Red Hat certification exams.

      • Right to End a Chat Session: Red Hat may end an Expert Chat session at any time, including because the session has met the time limit above or because unacceptable or inappropriate topics have been raised.

      • No Consulting Services: Expert Chat does not, and is not intended to, provide consulting services. Red Hat technical support staff will not provide consulting on technical matters during Expert Chat sessions.

      • NO GUARANTEE: RED HAT DOES NOT GUARANTEE THE AVAILABILITY OF AN EXPERT TO RESPOND TO ANY SPECIFIC CHAT INQUIRY AT ANY SPECIFIC TIME, OR THAT A SPECIFIC CHAT INQUIRY FROM A NAMED PARTICIPANT WILL BE RESOLVED IN ANY EXPERT CHAT SESSION OR OTHERWISE.

    • RHLS - Standard Expert Extras: Expert Extras are pre-recorded video sessions provided as part of the RHLS - Standard subscription. Red Hat will publish Expert Extras content as it becomes available. Red Hat reserves the right to remove Expert Extras content at Red Hat’s discretion.

    • Courses and Exams Included: A Red Hat Learning Subscription – Developer includes only those courses, Individual Exams, and Preliminary Exams that are relevant to the job role of developer. See www.redhat.com/training for more information.

    • Access to Labs: A Red Hat Learning Subscription - Developer includes up to one hundred (100) hours of lab access. Red Hat reserves the right to periodically remove inactive lab environments. Lab environments that have not been accessed within the preceding seven (7) day period are subject to deletion. Some exclusions may apply. As long as a Named Participant has enough remaining lab hours, they may re-provision a lab for the course in question. However, as part of the aforementioned deletion, any progress or state information of the deleted lab will be lost and will not be restored upon the re-provisioning of the lab.

    • Exams for RHLS-Developer Named Participants: All of the same terms and conditions for Individual Exams and Preliminary Exams included in an RHLS - Standard subscription apply to Individual Exams and Preliminary Exams included as part of an RHLS – Developer subscription, except as otherwise provided below.

      • RHLS-Developer includes up to three (3) Red Hat Individual Exams or Preliminary Exams, subject to the conditions below.

      • Exam entitlements included in RHLS-Developer may be used for a first attempt at an exam or a retake of an exam.

      • Exam entitlements included with an RHLS – Developer subscription must be consumed during the one (1) year subscription period. Exams entitlements included in the RHLS – Developer subscription may not be used after the subscription has expired, and may not be carried over into a renewal term of a subscription.

      • A Named Participant exam candidate should (but is not required to) complete the learning requirement associated with a given exam in order to register for a first attempt of an exam in a subscription year. Exams and their recommended learning paths are displayed on the Red Hat Learning Subscription Portal.

      • Failure to comply with the terms and conditions concerning exam security and confidentiality may result in forfeiture of exam attempts included in RHLS - Developer.

    • All Red Hat Learning Subscription - Basic and Red Hat Learning Subscription - Standard terms and conditions, apply to the Basic and Standard versions of Red Hat Learning Subscription Enterprise Solution.

    • RHLS Enterprise - Basic (LS120-100) and RHLS Enterprise - Standard (LS220-100), include a quantity of 100 individual Red Hat Learning Subscriptions. The total number of subscriptions in these SKUs cannot be modified.

    • A customer may purchase either the Basic or Standard version of RHLS Enterprise. RHLS Enterprise SKUs will either be all Basic or all Standard. No mixing of Basic and Standard subscriptions is allowed.

    • Only employees or contract employees of the end customer organization may be Named Participants (with each Named Participant entitled to participate in one subscription) under an RHLS Enterprise order.

    • No resale or redistribution of Red Hat Learning Subscription or Red Hat Learning Subscription Enterprise is allowed, except by an Authorized Red Hat Training Reseller Partner.

    • RHLS Enterprise - Developer (LS301) includes up to 500 individual Red Hat Learning Subscription Developer subscriptions. The total number of individual subscriptions in this SKU may not be more than 500.

    • Only employees or contract employees of the end customer organization may be Named Participants (with each Named Participant entitled to participate in one subscription) under an RHLS Enterprise order.

    • No resale or redistribution of Red Hat Learning Subscription or Red Hat Learning Subscription Enterprise is allowed, except by an Authorized Red Hat Training Reseller Partner.

    Bundles

    A “bundle” is a combination of courses, labs, or exams, sold and priced as a single product offering.

    • No Cancellation in Part: If Client purchases a bundle that is cancelable, it can only be canceled as a whole. Individual components of a bundle cannot be canceled and bundles that include an Individual Exam may not be canceled. Once any component of a bundle has been used, the bundle as a whole cannot be canceled. Individual components of Bundles are subject to the rescheduling policies defined within these Policies.

    • NOTE: Bundles that include an Individual Exam may not be canceled.

    Course-Specific Terms and Conditions

    • DO700 – Container Adoption Boot Camp

      • Registration Guideline: Customers are advised to purchase DO700 two (2) weeks or more prior to the class start date in order to allow the enrolled Named Participant(s) enough time to access their included RHLS – Standard subscription and complete the pre-work required for the course.

      • Available Modalities: The DO700 course is available to be delivered in Open Enrollment training and Onsite Training.

      • What is Included: The DO700 course includes the following components: (1) Participation by Named Participant in an instructor-led DO700 class; (2) A one (1) year subscription to RHLS – Standard.

      • DO700 Course Pre-Work: The DO700 requires all Named Participants to complete pre-work specified by Red Hat prior to the start date of the instructor-led portion of the course. Named Participants will be provided with instructions for completing their pre-work using their included RHLS – Standard subscription.

      • RHLS Terms and Conditions: All RHLS – Standard terms and conditions herein apply to the RHLS – Standard subscription included in DO700, unless otherwise provided in this section.

      • Activation of RHLS – Standard Subscription: The RHLS – Standard subscription included in DO700 will be activated no sooner than two (2) weeks prior to the DO700 course start date. Actual activation within this two (2) week window will depend on the date when the Named Participant has purchased and is enrolled in the class.

      • Cancellation of DO700 by Named Participant: Standard open enrollment, onsite and bundle cancellation terms and conditions herein, shall apply to the cancellation of DO700 by the Named Participant. Upon activation of the RHLS – Standard subscription included with DO700, no portion of the course may be canceled by the Named Participant, and no refund will be provided, under any circumstances.

    Training Units (TU)

    • Redemption:

      • Training Units must be scheduled and redeemed within 12 months of the date of purchase, even if the training event for which TUs are being redeemed is scheduled to start after the Training Unit expiration date.

      • Training Units may only be redeemed for eligible Red Hat training products and services offered on Red Hat’s Training website. Training Units cannot be redeemed for other training units, or for other Red Hat non-training products and services.

      • Training Units purchased in the United States or Canada can be redeemed in either country.

      • Training Units may be redeemed individually or in multiples as required to pay for the Red Hat training service for which they are being redeemed.

    • No Cancellation of Training Unit Purchases: All purchases of Training Units are final, and non-refundable.

    • Cancellation and Rescheduling of Training Purchased with Training Units: Cancellation or rescheduling of training purchased with Training Units is subject to the applicable policies referenced herein for the training services in question.

    • Permitted Access: Participant is responsible for ensuring that Training Units are only accessed by authorized users, and in accordance with the terms and conditions of Client’s Agreement with Red Hat.

    • Suspension: Training Unit accounts may be suspended if the account is not in good standing with Red Hat.

    • Expiration Date: Training Units may be used to purchase future services to be rendered after the expiration date of the Training Units as long as the order is placed before the expiration date of the Training Units. If an event is canceled (by either Red Hat or Client) after the expiration of the Training Units used to purchase it, the value of the Training Units will be forfeited.
